Terms of use

1. Access to the studio

The studio is used with an account, created in one click with Google or with a code sent by email. On your first visit, your browser receives a visitor identifier (see the Cookies page) that links your proposals and drafts to this browser. A resume code lets you find them on another device: keep it to yourself, as it gives access to your projects. The studio is for adults only (18 or over).

Two ideas (four proposals each) and ten edits are given to every new account, once; beyond that, creation is paid in credits, following the rates on the pricing page. Daily limits protect the service. We may change the free features of the studio.

2. Prohibited uses

You agree to use the website and the studio fairly and lawfully. In particular, it is prohibited to:

• create or publish a marketplace devoted to a prohibited activity or, without meeting its conditions, a restricted one (see the section “Prohibited and restricted activities”);
• impersonate a third party or use their brand, or copy an existing website to deceive its users;
• publish hateful, defamatory, violent or misleading content, or content that infringes the rights of others;
• circumvent usage caps, automate access to the studio, mass-extract its content, or attempt to access the code, other users’ data or the service’s systems;
• send the assistant sensitive personal data about third parties without a legal basis.

3. Prohibited and restricted activities

Rules that apply in every country. Marketplace Factory is operated by a company established in France and relies on payment, artificial-intelligence, hosting and email providers. Every marketplace created with Marketplace Factory must comply at the same time with:

• French law, which applies to our own services whatever your country;
• the law of the countries where you are established and of those your marketplace targets;
• the terms of our providers, which apply in every country.

Where these rules differ, the strictest one applies. An activity that is legal in your country may therefore be prohibited on Marketplace Factory.

Prohibited activities. You may not create, publish or operate with Marketplace Factory any marketplace, listing or content devoted, even in part or under another name, to the following activities. They are prohibited in every country, even where they are legal:

• paid sexual services in any form (escorting, prostitution, sexual massage, companionship or dating in exchange for money or benefits), adult content and shows, sexually oriented dating, and any sexual content involving minors;
• narcotics and psychoactive substances, including cannabis where it is legal, as well as their seeds, growing and consumption equipment;
• peer-to-peer money transfers, currency exchange, crypto-assets (exchange, mining, staking, token offerings), high-cost short-term credit, debt collection and debt relief;
• counterfeits, piracy, stolen goods or goods of doubtful origin;
• fake documents, fake reviews, the sale of followers, audience or personal data, fraud, hacking, pyramid schemes and multi-level marketing;
• prescription medicines outside an authorised pharmacy, and the distance selling of tobacco and nicotine products to or from France;
• airlines, commercial cruises, international charter flights and timeshares;
• harm to persons and to the human body (trafficking, exploitation, surrogacy, trade in organs or human body parts, surveillance of a person without consent), trade in protected species, hateful, violent or extremist content, and dangerous products (explosives, doping agents, jammers, unlabelled chemicals).

Restricted activities. Some activities are only possible under conditions: gambling and betting, weapons and ammunition sold by a licensed firearms dealer, non-compensated dating, sexual wellness, compliant CBD, alcohol, tobacco outside France, pharmacy, health and telemedicine, animals, hunting and shooting, regulated finance, package travel, creator platforms, psychic services, private security, donations and charities, sports tips without prizes, weight loss, pyrotechnics. Depending on the activity:

• generating the preview remains free;
• going live may depend on one or more conditions: a licence or authorisation that we verify, a review of your site by our team, an age check, the review of your texts by a qualified professional, or a Dedicated plan contract;
• online payment may depend on the prior approval of our payment provider.

We may refuse, suspend or withdraw at any time an authorisation given to a restricted activity, in particular if one of our providers withdraws it.

Countries. We do not open accounts, sell our services or create marketplaces:

• for persons or entities established in a country or region subject to international sanctions or excluded by our providers;
• for a marketplace that targets such a country or region;
• for a person listed on an asset-freeze list.

Some activities are also prohibited in certain countries. In countries where our artificial-intelligence providers are not available, the studio works without it. The up-to-date list of activities, their conditions and the countries is on the “Prohibited and restricted activities” page of this website.

Your commitments. You represent and warrant that:

• the description of your project and the information you give us, in particular about your licences, are accurate and complete;
• your activity, and that of the sellers on your marketplace, are lawful in your country and in those your marketplace targets;
• you comply with your obligations as the operator of your marketplace, for example, in the European Union, appointing a legal representative if you are not established there, identifying your professional sellers and handling notices;
• you moderate the listings and content published on your marketplace and promptly remove those that are unlawful or prohibited;
• you do not try to circumvent these rules, in particular by rewording, splitting or disguising the description of a prohibited activity.

Checks and measures. We check, automatically and then by a person, the descriptions entered in the studio and the content of published marketplaces. Where an activity is prohibited, we decline to generate the site, without charging anything. A listing or profile that appears to relate to a prohibited activity is set aside for review, never deleted without a decision. In case of breach, we may, after informing you where possible and giving our reasons:

• remove content;
• suspend a marketplace’s publication or its online payments;
• suspend your access;
• terminate your subscription.

The financial consequences of these measures are governed by our terms of sale. We keep a record of declined descriptions for six months, and of our decisions for twelve months. You may contest a decision at any time by requesting a review from the studio or by writing to contact@marketplacefactory.com: a person from our team will reply.

Indemnity. You indemnify us against any claim, penalty or judgment resulting from an activity carried out on your marketplace in breach of this clause.

4. Your content

You remain the owner of the text, photos, logos and information you enter or import. You guarantee that you hold the rights needed to use them, and you authorize us to host, process and display them only to the extent necessary for the studio and your marketplace to work.

5. Artificial intelligence

The studio relies on artificial intelligence models from specialized providers to write, edit, translate and illustrate. The sentences and texts needed for the requested task are sent to them; the list of these providers is in the privacy policy.

Generated content may contain errors, approximations or unverified claims: review it before publishing. The examples in the gallery are fictitious demonstrations; any resemblance to an existing business would be coincidental.

The photos suggested during creation come from a shared Marketplace Factory photo library. You use them on your site, non-exclusively. Photos created from your own content remain yours.

6. Report unlawful content

Anyone can report content they consider unlawful, on this website or on a marketplace built with Marketplace Factory, to contact@marketplacefactory.com, stating the address of the page, the content in question and the reasons for the report, along with their contact details. We handle reports diligently and give reasons for our decisions. A marketplace published by a customer is published by that customer, who is responsible for its content; we may nevertheless suspend its publication in the event of manifestly unlawful content.

On a marketplace built with Marketplace Factory, the “Report” link on each listing, each profile and in the footer also lets anyone report content, with or without an account. Where the law requires it, in particular in cases of pimping, drug trafficking or a threat to a person’s life or safety, we inform the competent authorities.

7. Intellectual property

The website, studio, marketplace templates, blocks, texts and graphic elements of Marketplace Factory are protected. Their use is limited to what the studio and your subscription allow: no reproduction, extraction or reuse outside the service is permitted without written agreement.

8. Liability and availability

The free studio is provided as is. We do our best to keep it available and error-free, without being able to guarantee it: back up what matters to you, for example by creating an account or noting your recovery code. We cannot be held liable for any use of the studio contrary to these terms.

9. Suspension of access

We may suspend studio access for a visitor or an account that breaches these terms, in particular in the event of unlawful or abusive use, after informing them where possible.

10. Changes and governing law

We may amend these terms; the applicable version is the one published on this page on the date of your use. They are governed by French law. Any dispute between professionals falls under the jurisdiction of the tribunal des activités économiques de Paris; for a user acting as a consumer, the statutory rules on jurisdiction apply.

When you create an account, we keep the version of these terms that you accepted and the date of your acceptance.
